1. Foreign individuals who make direct investment in Vietnam under the investment in Vietnam under the enterprises law, including domestic enterprises and foreign-invested enterprises;
2. Foreign individuals who have made contributions to Vietnam and are conferred orders or medals by the President of the Socialist Republic of Vietnam; foreign individuals who have made special contributions to Vietnam as decided by the Prime Minister;

(S&BLaw) Under Vietnam Law on Investment, in case a foreign investor wishes to setup a foreign invested company (FIC), it requires an Investment Certificate from the licensing authority. Depending on the location of the FIC, the licensing authority may be the provincial People's Committee (for companies located outside industrial or export processing zones) or the provincial Industrial and Export Processing Zones Management Authority (for companies located in industrial or export processing zones).
(S&BLaw) Under the Vietnam Law, following taxes may affect to the foreign invested company in Vietnam:
Corporate Income Tax which is levied on the taxable income of the FIC. Taxable income of the FIC to be calculated Corporate Income Tax shall be revenues generated in its course of production less reasonable expenses in the relevant fiscal year. Generally, the tax rate of the Corporate Income Tax is 25% of the taxable income.

1. Trademark search (Optional):
In order to verify the registrablity of your trademark in Vietnam before officially filing trademark application at National Office of Intellectual Property (NOIP), you should conduct a search of the trademark. The result will show whether or not your trademark is similar to trademark registered by other applicants for the same product/service. In addition, the result will also indicate that the launching of your product under your trademark/brand name into Vietnam market is legal or illegal by that time.

MPI has a plan to direct FDI flows into sectors such as high technology and support industries. Can this be easily done?
FDI comes from the private capital of foreign investors and under Vietnamese law they have the right to select the sector for and location of their investment. The direction for 2010 comes from the needs of our economy and the expectation that we will have balance among industries and sectors attracting FDI. Making this happen, however, is another thing altogether.

Foreign workers staying in Vietnam for longer than three months will be denied visas or even forced to leave the country if they do not have work permit or if their permit is expired.
This is a new regulation stipulated in an amended draft decree on the management and recruitment of foreign workers in the country. The draft decree prepared by the Ministry of Labour, War Invalids and Social Affairs (MoLISA) will be submitted to the government and if it is approved it will come into effect as of July 1.
