Decree 64/2012/ND-CP dated 4 September 2012 on construction permit (the “Decree 64”).

Decree 64 takes effect on 20 October 2012 and replacing the regulations on construction permit in Decree 12/2009/ND-CP, Decree 83/2009/ND-CP, Decree 39/2010/ND-CP.

Like the previous regulation, Decree 64 requires the investors obtaining construction permit before construction except some certain cases.

From the date of receiving a valid application file, the construction licensing authority must consider for licensing issue within the deadline specified below:

a) In the case of new construction permit, including temporary construction permits, adjustment construction permits and relocation permits, the time limit is not more than 20 working days for the works; 15 working days for individual houses in urban areas; 10 working days for rural houses, as from the date of receiving complete and valid dossier;

b) In case of re-issuance or extension of construction permit: Not more than 10 working days.

The above time can be expanded for reviewing the dossiers but not exceed of 10 days ahead.

Decree 64 provides that construction permit for each construction is only permitted to be amended once. In case of modification of 02 times or more, it must propose new construction permit.

Decree 64 allowsthat within 30 days, before the construction permit expires, if the work has not been started, the investor must request the extension of construction permit. Each construction permit is extended only once. Extension period shall not exceed 6 months. Upon the expiration of the extension period, the investor has not yet started construction; they must apply for a new construction permit.
